These Terms and Conditions (“Terms”) govern your access to and use of the website, services, communications, memberships, and related offerings provided by Sunshine Legacy Concierge, LLC (“Company,” “Sunshine Legacy Concierge,” “we,” “our,” or “us”). By using our website, submitting an inquiry, scheduling a consultation, enrolling in services, signing a service agreement, or making payment, you agree to these Terms.
Sunshine Legacy Concierge, LLC is an Oklahoma limited liability company providing non-medical concierge, lifestyle support, family communication, appointment coordination, transportation assistance, and related personal support services within the State of Oklahoma only.
Nature of Services
Sunshine Legacy Concierge is a non-medical concierge service. We are not a medical provider, home health agency, nursing agency, assisted living facility, emergency response provider, legal advisor, financial advisor, or licensed healthcare provider.
Our services may include, depending on the client’s selected membership plan or written service agreement:
In-person concierge visits
Lifestyle support
Appointment scheduling and coordination
Transportation assistance
Appointment accompaniment
Errands and personal assistance
Grocery and prescription pickup coordination
Family updates
Home wellness observations
Vendor or contractor coordination
Technology assistance
Organization support
Move or downsizing coordination
Other non-medical concierge services agreed to in writing
No Medical Care or Healthcare Services
Sunshine Legacy Concierge does not provide medical care, nursing care, home health services, personal care services, emergency medical services, medication administration, medical decision-making, medical diagnosis, medical treatment, wound care, bathing, toileting, feeding assistance, lifting, transferring, dementia care, memory care, medication management, or any regulated healthcare service.
We do not replace physicians, nurses, home health agencies, licensed caregivers, assisted living providers, emergency services, or family decision-makers.
Any information observed or communicated by Sunshine Legacy Concierge is for general family awareness and concierge coordination only and should not be interpreted as medical advice, clinical assessment, diagnosis, or treatment recommendation.
If a client is experiencing a medical emergency, call 911 immediately.
Service Area
Sunshine Legacy Concierge currently provides services only within the State of Oklahoma. Specific service areas may include Edmond, Oklahoma City, and surrounding Oklahoma communities, subject to availability and written approval by the Company.
We reserve the right to decline service requests outside our service area or outside the scope of our non-medical concierge services.
Eligibility and Client Responsibility
Clients must be legally capable of entering into an agreement or must have an authorized representative, legal guardian, power of attorney, or responsible family member who is legally authorized to contract for services.
The client or responsible party agrees to provide accurate and current information, including:
Emergency contacts
Medical emergency contacts
Authorized family representatives
Known allergies or safety concerns
Home access instructions
Transportation needs
Mobility limitations
Relevant household information
Any information reasonably necessary for safe and appropriate service delivery
The client or responsible party is responsible for promptly notifying Sunshine Legacy Concierge of any changes that may affect services.
Annual Membership Term
Unless otherwise stated in a signed written agreement, Sunshine Legacy Concierge memberships are annual agreements with an initial term of twelve (12) months beginning on the effective date of the signed agreement.
Memberships are not month-to-month during the initial annual term unless expressly agreed to in writing by Sunshine Legacy Concierge.
Automatic Renewal
At the end of the initial annual term, the membership will automatically renew for additional one-year terms unless either party provides written notice of non-renewal at least thirty (30) days before the renewal date.
Written notice may be sent by email to concierge@sunshinelegacyconcierge.com or by another written method approved in the client’s service agreement.
Cancellation Policy
A client may cancel future renewal of services by providing at least thirty (30) days’ written notice.
Cancellation does not eliminate amounts already due, amounts incurred before the effective cancellation date, or amounts owed for the current billing period.
If a client cancels during the initial annual term, the client remains responsible for all amounts due under the signed annual agreement unless otherwise agreed to in writing by Sunshine Legacy Concierge.
No Refunds
All fees paid to Sunshine Legacy Concierge are non-refundable. This includes, but is not limited to, membership fees, monthly service fees, setup fees, consultation fees, transportation fees, add-on service fees, and any other amounts paid.
No refunds or credits will be issued for unused visits, unused services, client scheduling conflicts, declined services, missed appointments, travel, illness, relocation, family decisions, or early cancellation unless required by law or expressly agreed to in writing by Sunshine Legacy Concierge.
Billing and Payment
Billing is completed monthly in advance and is not billed in arrears.
Monthly membership fees are due on the first (1st) day of each month.
Accepted payment methods include ACH and credit card.
Clients authorize Sunshine Legacy Concierge to charge the payment method on file for recurring monthly membership fees, approved add-on services, transportation fees, processing fees, late fees, and other authorized charges.
Mid-Month Enrollment and Proration
If a client begins services in the middle of a month, Sunshine Legacy Concierge may prorate the first partial month based on the service start date.
The prorated amount for the partial month is due at signing or before services begin. The first full monthly membership payment will then be charged on the first (1st) day of the following month.
Example: If services begin on June 15, the client may be charged a prorated amount for June 15 through June 30 at signing, and the first full monthly membership fee will be charged on July 1.
Sunshine Legacy Concierge reserves the right to require the prorated first month and the next full month to be paid before services begin.
Credit Card Processing Fees
Clients who choose to pay by credit card are responsible for applicable credit card processing fees, surcharge fees, or convenience fees to the extent permitted by law and applicable card network rules.
ACH payment is available as an alternative payment method.
Any credit card processing fee will be disclosed to the client before processing when required.
Failed Payments and Late Payments
If a payment is declined, returned, reversed, disputed, or otherwise not successfully processed, the client agrees to promptly provide an alternate payment method.
Sunshine Legacy Concierge may suspend services for accounts with failed or overdue payments.
A late fee of $25 may be assessed for payments not received within 5 days after the due date.
Returned ACH payments may be subject to a returned payment fee of $35.
The client remains responsible for all amounts owed, including collection costs, attorney fees, chargeback fees, and other costs incurred by Sunshine Legacy Concierge in collecting unpaid balances, to the extent permitted by law.
No Guarantee of Availability
Services are provided based on scheduling availability, staffing availability, geographic location, client needs, and service scope.
Sunshine Legacy Concierge will make reasonable efforts to accommodate requested visit times, transportation times, appointment support, and urgent requests, but we do not guarantee availability for every requested date, time, or service.
Services requiring advance scheduling should be requested as early as possible.
Scheduling, Missed Visits, and Rescheduling
Clients are responsible for providing accurate appointment times, addresses, access instructions, and service details.
If a client cancels, reschedules, is unavailable, refuses service, fails to provide access, or provides incorrect information with less than 48 hours notice, the visit may be considered used and may not be credited or refunded.
Sunshine Legacy Concierge may reschedule services due to weather, road conditions, safety concerns, illness, emergency, vehicle issues, or other circumstances beyond our reasonable control.
Transportation Assistance
When transportation assistance is provided, Sunshine Legacy Concierge is not a medical transportation provider, ambulance service, wheelchair transport provider, or emergency transportation provider.
Clients must be able to safely enter, exit, and ride in a standard passenger vehicle without physical lifting or medical assistance unless otherwise agreed in writing and within the scope of non-medical services.
Sunshine Legacy Concierge reserves the right to refuse transportation if, in our judgment, transportation would be unsafe, inappropriate, outside the scope of services, or better handled by emergency medical services, non-emergency medical transportation, a licensed care provider, or another appropriate provider.
Clients are responsible for all third-party transportation costs, parking fees, tolls, mileage fees, waiting time, and related expenses unless otherwise included in the selected membership plan.
Appointment Accompaniment
Sunshine Legacy Concierge may accompany clients to appointments for general support, note-taking, scheduling assistance, transportation coordination, or family communication.
We do not provide medical interpretation, medical advice, diagnosis, treatment recommendations, consent to medical treatment, or make medical decisions on behalf of the client.
The client, legal representative, healthcare proxy, guardian, or authorized family member remains solely responsible for medical decisions.
Family Updates and Communication
Sunshine Legacy Concierge may provide updates to authorized family members or representatives as part of selected services.
Updates are based on general observations and information available at the time and are not medical assessments, clinical evaluations, safety guarantees, or professional opinions.
Clients and responsible parties are responsible for identifying who is authorized to receive updates.
Emergency Situations
Sunshine Legacy Concierge is not an emergency response service.
If we observe or become aware of a potential emergency, we may call 911, contact emergency contacts, contact family members, or take other reasonable action based on the situation.
The client and responsible party authorize Sunshine Legacy Concierge to contact emergency services if we believe immediate assistance may be needed.
Sunshine Legacy Concierge is not liable for the actions, omissions, delays, decisions, costs, or outcomes related to emergency responders, healthcare providers, hospitals, law enforcement, family members, or third parties.
Home Access and Safety
Clients are responsible for providing safe access to the home or service location.
Sunshine Legacy Concierge may refuse or discontinue service if a location is unsafe, unsanitary, threatening, abusive, inaccessible, or otherwise inappropriate.
Clients are responsible for securing pets, firearms, hazardous materials, unsafe areas, aggressive individuals, or other risks before scheduled visits.
Third-Party Vendors and Referrals
Sunshine Legacy Concierge may assist with coordinating third-party vendors such as contractors, cleaners, organizers, transportation providers, repair professionals, movers, or other service providers.
Unless expressly stated in writing, third-party vendors are independent providers and are not employees, agents, partners, or subcontractors of Sunshine Legacy Concierge.
Sunshine Legacy Concierge is not responsible for the acts, omissions, pricing, workmanship, delays, negligence, damages, or representations of third-party vendors.
Client Property
Sunshine Legacy Concierge may assist with errands, personal items, groceries, prescriptions, documents, household items, or other property as part of concierge services.
Clients agree not to request handling of large sums of cash, valuables, controlled substances, firearms, hazardous materials, or illegal items.
Sunshine Legacy Concierge is not responsible for loss or damage to personal property except to the extent caused by gross negligence or willful misconduct as determined by applicable law.
Medication and Prescription Pickup
Sunshine Legacy Concierge may assist with prescription pickup or delivery coordination when permitted by law and pharmacy policy.
We do not administer medication, prepare medication, determine dosage, remind clients in a medical capacity, manage medication schedules, or advise regarding medication use.
All medication decisions remain solely with the client, family, physician, pharmacist, or licensed medical provider.
Confidentiality and Privacy
Sunshine Legacy Concierge respects client privacy and will use reasonable efforts to protect personal information.
We may collect personal information through website forms, consultations, service agreements, intake forms, payment processing, scheduling communications, SMS, email, and service-related interactions.
Information may be used to provide services, communicate with authorized contacts, process payments, schedule visits, respond to inquiries, and operate the business.
We do not sell or rent personal information.

SMS/Text Messaging Consent
By providing a phone number and opting into SMS communications, the client or website visitor consents to receive text messages from Sunshine Legacy Concierge related to inquiries, scheduling, appointment reminders, service updates, transportation confirmations, customer care, and family communication.
Message frequency varies. Message and data rates may apply.
Consent is not a condition of purchase.

Sunshine Legacy Concierge does not sell, rent, or share mobile opt-in information or SMS consent with third parties for marketing purposes.
Website Use
The Sunshine Legacy Concierge website is provided for general informational purposes only.
Website content does not constitute medical, legal, financial, insurance, or professional advice.
We do not guarantee that website content is complete, accurate, current, or suitable for every situation.
We may update, modify, suspend, or remove website content at any time without notice.
Intellectual Property
All website content, service descriptions, text, graphics, logos, images, designs, forms, materials, and branding are owned by or licensed to Sunshine Legacy Concierge and may not be copied, reproduced, modified, distributed, or used without written permission.
Prohibited Use
Users may not use the website or services to:
Violate any law or regulation
Submit false or misleading information
Harass, threaten, abuse, or harm Company representatives
Request illegal or unsafe services
Interfere with website functionality
Attempt unauthorized access to Company systems
Misrepresent authority to act on behalf of a client
Use services for medical care, emergency care, or regulated care outside our service scope
Right to Refuse or Discontinue Services
Sunshine Legacy Concierge reserves the right to refuse, suspend, or discontinue services at any time if we determine that:
The requested service is outside our scope
The client requires medical, personal care, or regulated care services
The environment is unsafe
Payment is overdue
The client or family member is abusive, threatening, or inappropriate
Continued services would create unreasonable risk
Services are no longer suitable for the client’s needs
The client has provided inaccurate or incomplete information
No Warranty
Services are provided “as is” and “as available.”
Sunshine Legacy Concierge makes no guarantee that services will prevent accidents, medical events, falls, emergencies, hospitalization, decline in health, property damage, family conflict, or other outcomes.
We do not guarantee specific results, health outcomes, safety outcomes, family outcomes, or service availability at all requested times.
Limitation of Liability
To the fullest extent permitted by law, Sunshine Legacy Concierge, LLC, its owners, members, managers, employees, contractors, agents, and representatives shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the website, services, communications, transportation assistance, third-party vendors, scheduling, family updates, or client decisions.
To the fullest extent permitted by law, the total liability of Sunshine Legacy Concierge for any claim shall not exceed the amount paid by the client to Sunshine Legacy Concierge during the one (1) month immediately preceding the event giving rise to the claim.
Indemnification
The client and responsible party agree to indemnify, defend, and hold harmless Sunshine Legacy Concierge, LLC, its owners, members, managers, employees, contractors, agents, and representatives from and against any claims, damages, losses, liabilities, costs, expenses, attorney fees, or demands arising out of or related to:
Client-provided information
Client health conditions or emergencies
Medical decisions or outcomes
Third-party vendor services
Unsafe premises
Transportation requests
Family disputes
Unauthorized requests
Breach of these Terms
Violation of law
Misrepresentation of authority to act for the client
Governing Law
These Terms and any related agreements shall be governed by and interpreted under the laws of the State of Oklahoma, without regard to conflict of law principles.
Venue and Jurisdiction
Any dispute arising out of or related to these Terms, the website, or services shall be brought in the state or federal courts located in Oklahoma County, Oklahoma, unless otherwise required by law or agreed in writing.
Dispute Resolution
Before filing any legal action, the parties agree to attempt in good faith to resolve disputes informally by written notice and discussion.
Either party may request mediation before litigation. Mediation shall take place in Oklahoma County, Oklahoma unless otherwise agreed.
Force Majeure
Sunshine Legacy Concierge shall not be liable for delay or failure to perform caused by events beyond our reasonable control, including severe weather, road closures, illness, emergencies, natural disasters, acts of God, labor shortages, vehicle issues, government restrictions, utility outages, technology failures, civil unrest, or other circumstances outside our control.
Changes to Services or Pricing
Sunshine Legacy Concierge may update services, service areas, membership plans, fees, terms, or policies from time to time.
For existing annual clients, pricing changes will generally take effect at renewal unless otherwise stated in the signed service agreement or required due to changes in law, insurance, taxes, payment processing, fuel costs, or material operating costs.
Entire Agreement
These Terms, together with any signed service agreement, intake forms, payment authorization, privacy policy, transportation authorization, and other written documents provided by Sunshine Legacy Concierge, constitute the agreement between the parties.
If there is a conflict between these Terms and a signed service agreement, the signed service agreement will control.
Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
